These Terms & Conditions ("Terms") govern your use of the QuickHold Portable Toilets & Dumpsters website at quickholdrentals.com and the rental services provided by QuickHold Portable Toilets & Dumpsters ("QuickHold," "we," "us," or "our"). By using our website or placing a rental order, you agree to these Terms.
1. Rental Agreement
Each rental order is governed by these Terms together with the written quote, order confirmation, and any signed rental agreement specific to your order. In the event of any conflict, the written rental agreement controls.
2. Rental Period
The rental period begins on the delivery date and ends on the pickup date specified in your order. Rentals continued past the agreed pickup date are billed at the daily or weekly extension rate stated in your agreement.
3. Payment Terms
Quoted prices are valid for 14 days unless otherwise stated. Payment is due in accordance with the terms on your invoice. Accepted methods include credit card, ACH transfer, and approved corporate purchase orders. Past-due balances accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, plus collection costs and reasonable attorneys' fees.
4. Delivery and Pickup
Delivery and pickup windows are estimates. We are not responsible for delays caused by weather, traffic, site access, locked gates, blocked driveways, or other circumstances beyond our reasonable control. If our driver arrives and cannot complete delivery or pickup due to site conditions, a trip charge applies.
5. Site Access and Placement
You are responsible for providing safe, legal, and accessible placement for portable toilets and dumpsters. You confirm that the placement location is on property you own or have permission to use, that overhead and underground utilities are clear, and that surface conditions are adequate to support the equipment. QuickHold is not responsible for damage to driveways, lawns, sprinklers, septic systems, sidewalks, curbs, utilities, or other site features resulting from delivery, placement, service, or pickup of equipment in a location you designate.
6. Care of Equipment
You are responsible for the condition of rented equipment during the rental period. You agree not to move, alter, or relocate equipment without our prior approval. You are liable for damage beyond normal wear and tear, including but not limited to vandalism, graffiti, fire damage, theft, and damage from prohibited use, at the replacement or repair rates stated in your agreement.
7. Prohibited Use
7.1 Portable toilets
Portable toilets are for ordinary sanitation use only. You may not deposit or allow to be deposited any hazardous chemicals, paints, solvents, oils, oil filters, batteries, motor fluids, ignitable materials, medical waste, food waste, construction debris, or any items that may damage the unit or interfere with pumping and service.
7.2 Dumpsters
Dumpsters may be used only for the materials approved in your agreement. Prohibited items include, without limitation: hazardous waste, paints (unless fully dried), oils, solvents, fuels, batteries, tires, propane tanks, asbestos, medical waste, radioactive material, refrigerators or appliances containing refrigerants, and any items prohibited by federal, state, or local law or the receiving disposal facility. You are responsible for fees, fines, and remediation costs resulting from prohibited items in your dumpster, including special handling charges and disposal facility surcharges.
8. Weight Limits and Loading
Each dumpster has an included weight allowance stated in your agreement. Overages are billed per ton at the rate stated in your agreement. Dumpsters must not be loaded above the rim — drivers are legally prohibited from hauling overloaded containers, and a return trip after redistribution is billed as a trip charge.
9. Service Visits
Standard weekly service for portable toilets includes pumping, washdown, sanitization, and resupply of toilet paper and hand sanitizer. Additional service visits are available at the rates stated in your agreement. Missed service visits caused by site access issues (locked gates, blocked units) may be billed as trip charges.
10. Cancellations and Changes
Order cancellations or changes made at least 48 hours before the scheduled delivery date are accepted without charge. Cancellations or changes made within 48 hours of delivery may be subject to a cancellation or trip fee.
11. Indemnification
You agree to indemnify, defend, and hold harmless QuickHold and its affiliates, officers, employees, agents, and subcontractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the equipment, (b) your breach of these Terms, (c) any injury to persons or property caused by or related to the placement, use, or condition of equipment at your site, and (d) any prohibited materials placed in any unit or container.
12. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED IN YOUR WRITTEN AGREEMENT, QUICKHOLD PROVIDES EQUIPMENT AND SERVICES "AS IS" AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUICKHOLD'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY RENTAL ORDER OR THESE TERMS IS LIMITED TO THE AMOUNTS PAID BY YOU TO QUICKHOLD UNDER THE RELEVANT RENTAL ORDER. IN NO EVENT WILL QUICKHOLD BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, OR LOSS OF BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14. Governing Law
These Terms are governed by the laws of the state in which the rental is performed, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or any rental order must be brought exclusively in the state or federal courts located in that state, and you consent to personal jurisdiction and venue there.
15. Website Use
You may use our website for lawful purposes only. You may not copy, reproduce, modify, distribute, or create derivative works of the website or its content without our prior written consent. We may modify, suspend, or discontinue the website at any time without notice.
16. Intellectual Property
All trademarks, logos, content, and design elements on the website are the property of QuickHold or its licensors and are protected by intellectual property laws.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
18. Entire Agreement
These Terms, together with your written rental agreement and any documents expressly incorporated, constitute the entire agreement between you and QuickHold and supersede any prior or contemporaneous understandings.
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where appropriate, communicated by additional notice. Continued use of the website or services after changes take effect constitutes acceptance.
